As a condition of using the service, you must agree to these terms of service (hereinafter referred to as the "Agreement"). By using or otherwise accessing the service, you agree to this Agreement. If you do not agree to this Agreement, you must not use or otherwise access the service. Unless otherwise specified in the applicable service components, the service may be used or downloaded for free, but may include features that allow you to make purchases within the service.

About

By downloading our game, you accept this Agreement and our Privacy Policy. Your relationship with YX Games will be governed by these agreements and privacy policies. Each time you download our game to your device, you enter into a new Agreement, the terms of which apply to your use of the game. By using or otherwise accessing the service, you agree to this Agreement. If you do not agree to this Agreement and our Privacy Policy, you must not use or otherwise access the service.

App stores and platforms may provide their own terms that apply to your relationship with those app stores and platforms. You declare that you are at least 13 years old. If you are under 13 years old, you may only download our game and play it on your device if your parent or legal guardian has reviewed this Agreement and allowed you to do so. YX Games may require you to provide sufficient proof of identity and age and obtain consent from a parent or guardian at any time.

User Content

"User Content" refers to any and all content that the user uploads, distributes, or otherwise provides through any game. You are solely responsible for your User Content. You assume all risks associated with the use of your User Content, including any reliance by others on its accuracy, completeness, or usefulness, or the disclosure of your User Content that identifies you or any third party. You hereby represent and warrant that your User Content does not violate the Acceptable Use Policy (defined below). You may not claim or imply that your User Content is in any way provided, sponsored, or endorsed by YX Games. YX Games has no obligation to back up any User Content, and User Content may be deleted at any time. If you wish, you are solely responsible for creating backup copies of your User Content.

This User Agreement is effective indefinitely. If we have reason to believe that you have materially breached these terms of service, we may suspend your access to our games or terminate this User Agreement. Either party may terminate this User Agreement without cause and without notice. Grounds for termination for cause include material breaches of these terms of service.

License

Under the terms of this Agreement, YX Games grants you a non-transferable, non-exclusive license to (a) use the game for your personal use, and (b) download, install, and execute copies of each game authorized by the download site on mobile devices that you own or control (the "License").

Ownership

The games provided to you are licensed to you, not sold to you. YX Games (and its licensors, as applicable) retains all rights, title, and interest in and to all games, including all associated intellectual property rights, except for your User Content (defined below). This Agreement does not constitute a sale and does not transfer any ownership of any game or any rights related to any game to you. The names, logos, and product names related to YX Games belong to YX Games (or its licensors, as applicable), and no rights to use them are granted or implied by this Agreement. YX Games (and its licensors, as applicable) reserves all rights not granted in this Agreement.

Disclaimer

5.1 The games are provided "as is," and YX Games (and its suppliers) expressly disclaims any warranties or conditions of any kind, whether express or implied, including warranties or conditions of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, or non-infringement. YX Games (and its suppliers) do not warrant that any game: (A) will meet your requirements; (B) will be uninterrupted, timely, secure, or error-free; or (C) will be accurate, reliable, complete, legal, or safe. 5.2 Certain jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.
